1.     Introduction

These Terms of Service (“Terms”) govern your access to and use of the Startrails Stacker application (“App”), operated by Startrails Stacker, a trade name owned and operated by Adam Steinberg, based in New Hampshire, United States (“we,” “us,” or “our”). By accessing or using the Startrails Stacker application or website, you agree to be bound by these Terms. If you do not agree, do not use the App or website.

2.     Eligibility

You must be at least 18 years old or have parental/guardian consent to use this App. By using the App, you represent that you meet this requirement and that all information you provide is accurate and up to date.

3.     License and Use

When you subscribe to the App, you are purchasing a revocable, non-exclusive, non-transferable license to use Startrails Stacker for your own purposes, whether personal or commercial. You do not own the software or any of its source code.

You may not:

-        Reverse engineer, decompile, or attempt to access the source code

-        Share, sublicense, or redistribute the App

-        Use the App for unlawful purposes or in a way that could damage, disable, or impair its functionality.

4.     Subscriptions and Payments

Subscriptions and payments are processed securely by lemonsqueezy.com acting as the Merchant of Record. By subscribing, you authorize Lemon Squeezy to charge your chosen payment method on a recurring basis (monthly or yearly, depending on your selected plan).

All billing, receipts, and tax invoices are handled through Lemon Squeezy in accordance with their terms and policies.

You can manage or cancel your subscription at any time via the Lemon Squeezy subscription management link provided in your purchase confirmation email.

5.     Refund Policy

Refunds may be granted on a case-by-case basis at our sole discretion. For example, refunds may be offered as part of promotional campaigns (such as users who share the App on their Instagram story) or in special circumstances.

Refunds are processed via lemonsqueezy.com, the authorized reseller and Merchant of Record for Startrails Stacker.

To request a refund, contact us via the information below and include your order details.

6.     Data Collection and Privacy

The App may automatically collect limited diagnostic or crash report data to help us identify and fix technical issues. This data may include error logs, device type, operating system version, and App usage information. We do not collect personal information unrelated to the App’s functionality.

All data is handled in accordance with our Privacy Policy.

We provide basic technical support via email or through the contact form on our website. Response times may vary depending on request volume and complexity.

8.     Intellectual Property

All intellectual property rights in the App, including its code, design, graphics, and documentation, remain the property of Startrails Stacker (a trade name owned and operated by Adam Steinberg). You may not reproduce or distribute any part of the App without prior written permission.

This ownership does not extend to third-party open-source libraries used within the application, including PySide6 (Qt for Python) and Qt Designer, which remain the property of their respective copyright holders and are licensed under the GNU Lesser General Public License (LGPL).

9.     Termination

We reserve the right to suspend or terminate your license and access to the App if you violate these Terms or misuse the software. Upon termination, you must immediately stop using the App and delete any copies you possess.

10.  Disclaimers

The App is provided “as is” without warranties of any kind, whether express or implied. We do not guarantee that the App will be error-free or uninterrupted. To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

11.  Limitation of Liability

To the fullest extent permitted by law, Startrails Stacker (a trade name owned and operated by Adam Steinberg) shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, data, or business opportunities, arising from your use or inability to use the App.

Your sole remedy for dissatisfaction with the App is to stop using it.

12.  Governing Law

These Terms are governed by the laws of the State of New Hampshire, United States, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in New Hampshire, United States.

If you access or use the App from outside the United States, you do so at your own initiative and are responsible for compliance with applicable local laws.

13.  Changes to These Terms

We may update or modify these Terms from time to time. Any changes will be effective upon posting on our website or within the App. Continued use after changes means you accept the revised Terms.

14.  Third-Party Libraries

Startrails Stacker uses third-party software components, including PySide6 (Qt for Python) and Qt Designer, both licensed under the GNU Lesser General Public License (LGPL). 

You may obtain, modify, and replace these libraries as permitted by their respective licenses. The source code for these libraries and their license texts are available from the Qt Project at https://www.qt.io/licensing.

In addition to PySide6 and Qt Designer, Startrails Stacker may use other open-source components licensed under MIT, BSD, or similar permissive licenses. These libraries are used in accordance with their respective terms, and their copyright notices are included within the distributed application files where required.

By using this application, you agree that these third-party components are provided under their respective licenses and that Adam Steinberg has no ownership or affiliation with the maintainers of these libraries.
